TERMS AND CONDITIONS 


Payment Terms 

For all standard, non-construction related jobs over $500, a deposit of fifty percent (50%) is due upon approval, with the remaining balance due immediately upon completion. 


For construction and renovation projects, payment terms are 30% upon approval, 40% upon rough-in completion, and the remaining balance upon trim completion. Equipment startup, grilles, and final adjustments may occur after final payment due to scheduling requirements of the General Contractor, owner, inspector, utility provider, or other third parties. 


All quotes are good for 30 days. Quoted pricing is valid for ninety (90) days from the date of approval unless otherwise stated. Projects delayed beyond ninety (90) days may be subject to price adjustments due to increases in equipment, material, labor, permit, tariff, or freight costs. 


Cancellations 

If a project is cancelled after equipment, materials, or permits have been ordered or obtained, Customer shall be responsible for all non-refundable material costs, permit fees, and a minimum administrative/restocking fee of $500. Special-order and non-returnable materials are non-refundable. 


Scheduling and Availability 

All sales are subject to equipment and material availability at the time of approval. Air America shall not be responsible for delays caused by permitting agencies, inspectors, utility companies, manufacturers, suppliers, weather conditions, labor shortages, acts of God, or other circumstances beyond its reasonable control. 


Change Orders 

Any work requested beyond the original scope of work shall be considered additional work and may result in additional charges. Change orders may be approved verbally, electronically, in writing, or documented through Air America's service management software. 


Existing Conditions 

Unless specifically included in the scope of work, existing ductwork, refrigerant piping, condensate piping, electrical systems, controls, structural components, roofing systems, framing, drywall, fire alarm systems, sprinkler systems, fire suppression systems, and other existing components shall remain in place and are not guaranteed by Air America. 


Air America is not responsible for the condition, performance, code compliance, or failure of existing components not included in the contracted scope of work. 


Air America shall not be liable for damages resulting from pre-existing conditions including, but not limited to, roof leaks, water intrusion, mold, termite damage, deteriorated framing or drywall, existing duct or piping defects, condensate drain failures, electrical deficiencies, code violations, activation of fire alarms or suppression systems, equipment vibration within manufacturer specifications, or personal property not removed from the work area prior to commencement of work. 


Existing duct systems and condensate drain systems are not guaranteed unless specifically replaced. Any concealed conditions, code deficiencies, permit-related corrections, structural deficiencies, or unforeseen conditions discovered during the course of work shall be considered additional work and billed separately. 


Warranty 

Air America provides a one (1) year labor warranty from the date of installation. Manufacturer parts warranties apply as provided by the equipment manufacturer. Residential equipment may qualify for extended manufacturer warranties upon proper registration. Warranty coverage does not include misuse, neglect, lack of maintenance, dirty filters, clogged drains, power surges, salt corrosion, acts of nature, unauthorized repairs, or conditions beyond Air America's control. All warranties are void until payment has been received in full. 


Collections and Lien Rights 

Past due balances may incur a $10.00 late fee and interest at the rate of 1.5% per month (18% annually), or the maximum rate permitted by law, whichever is less. Customer shall be responsible for all reasonable collection costs, attorney fees, court costs, and expenses incurred in collecting unpaid balances. 



Air America retains ownership of all equipment and materials furnished until payment is received in full and reserves all rights available under Florida law to recover unpaid amounts, including construction lien rights where applicable. 


General Provisions 

Customer shall provide safe and reasonable access to all work areas and remove any obstacles that may interfere with work being performed. Air America reserves the right to refuse or discontinue service where unsafe conditions exist or where work cannot be performed safely and in accordance with applicable codes and regulations. 

 

By signing below, Customer acknowledges that they have read, understand, and agree to the Terms and Conditions contained on Pages 1 and 2 of this Agreement.
